CCMA AND BARGAINING COUNCILS

Unispec Advisors & Associates is well known in the dispute resolution councils of South Africa (including the CCMA and Bargaining Councils) and prides itself on its good reputation gained in dealings with dispute councils over the last 19 years.
Unispec Advisors & Associates officials however, are permitted to represent Members in all cases.

LEGAL FUND

The cost of representation at any conciliation, mediation and/or arbitration, whether private, at a Bargaining or Statutory Council or at the CCMA, and in the Labour Court is borne by the fund (T&C’s apply).

CCMA/COUNCIL DAMAGE COVER FOR AN ARBITRATION AWARD

The Registered Member shall be insured annually against any arbitration awards made against the Member, as well as matters that the Member, at the discretion of the insurer, may decide to settle.
Providing security bond in a review application in the Labour Court, may also be supported in terms of conditions of the legal fund.

ON-SITE OR REMOTE ASSISTANCE

On-site assistance provides for the chairing of disciplinary enquiries, grievances, transfer of business, retrenchments, counselling, incapacity, poor performance enquiries, union negotiations, strikes and much more.

24 Hour Helpline

A 24-hour helpline is available to ensure that Members are able to obtain professional IR and HR advice at all times.

HR/IR AUDIT & LABOUR MANUAL

Upon receipt of the first month’s Membership fee and completion of the Employment Relations audit, new Members receive a Manual containing all the necessary contracts of employment, recognition agreements and other documentation relevant to employment relations management and administration.

SKILLS DEVELOPMENT FACILITATOR O.B.O. THE EMPLOYER

Unispec Advisors & Associates acts as the Skills Development Facilitator of the employer with the SETA.
Why outsource your SDF requirements every year if you can develop your own employees to manage your training in-house?
Unispec Advisors & Associates as your Skills Development Facilitator appointed, uploads your Workplace Skills Plan and Annual Training Report and qualification required.
Unispec Advisors & Associates will fulfil the role of Skills Development Facilitator to ensure your company’s annual submission of the Workplace Skills Plan, Annual Training Report and Pivotal plan is done on time.
We act as liaison with the relevant SETA on behalf of your company to help you claim for the mandatory grant.
Extensions of this service include:

Conducting skills audits,
Identifying training needs and making recommendations for B-BBEE purposes where applicable,
Assisting with an organizational skills gap analysis,
Assisting to develop a WSP based on the skills gap analysis.

SETA GRANT BENEFIT (SDF)

Unispec Advisors & Associates will implement learnerships, so your organisation can save money by applying for a SETA Grant after successful submission of your WSP & ATR.
These funds can be utilised for both your employees and unemployed learners and will count towards your B-BBEE spend on the Skills Development Element, saving the organisation on spending the required Skills Development spend out of pocket.
These funds can also be used for community upliftment projects that will count towards your Socio-Economic Development/Responsibility spend on your B-BBEE score card.

EMPLOYMENT EQUITY BENEFIT

When implementing a learnership, these learners will be “employed” by your organisation for the duration of the learnership. These employees will also assist in your Employment Equity Planning.
Unispec Advisors & Associates consultants provide, and do the following, on your behalf to your business advantages:

Schedule and chair EE meetings with your employees.
Interact with Department of Labour and assist with DOL inspections.
Completion and submission of your business EEA4 and EEA2 reports to DOL.

DEBT RECOUPMENT FROM YOUR CLIENTS

We can charge fees on a contingency basis whereby we retain a percentage of the capital collected as recoupment fees and agreed between both parties; or
We charge a set fee for certain items at a fixed rate, irrespective of time spent; or
We charge fees at an hourly rate as per our general mandate and fee agreement.

SARS INCENTIVES

Unispec Advisors & Associates assists your business with Learnerships, which can result in a double incentive from SARS.

It reduces an Employer’s cost of hiring young people through a cost-sharing mechanism with government, while leaving the wage the employee receives unaffected.
The employer can claim the ETI and reduce the amount of PAYE tax payable by the amount of the total ETI calculated in respect of all qualifying employees.
Unispec Advisors & Associates can implement Learnerships, which also qualify for rebates and incentives, including deductions as per section 12H of the Income Tax Act, as well as Youth Wage Subsidy incentives.

Section 12H of the Income Tax Act provides for an allowance to employers in respect of qualifying ‘registered learnership agreement(s)’ entered into between the employer and employee. The allowance is intended as an incentive for employers to train employees in a regulated environment in order to encourage skills development and job creation.

LEARNERSHIP ALLOWANCE

The allowance is made up of three parts:

An annual allowance – i.e. available in respect of each year of assessment in respect of which the learner is party to a registered learnership agreement; and
A completion allowance – a once off allowance available in the year of assessment in respect of which the learner successfully completes the registered learnership agreement and in addition to the annual allowance;
Assist your company with implementing Learnerships in your organisation and signing Learnership Agreements with the applicable SETA which will benefit your business.
