It is crucial for employers to have an up-to-date Harassment Policy in place – and we’re here to assist you.
 
On 18 March 2022, a new Code of Good Practice on the Prevention and Elimination of Harassment in the Workplace was officially gazetted, effectively replacing all previous discrimination and harassment protocols. This code is aligned with the South African constitution, safeguarding the fundamental rights to dignity, equality, and fair labour practices as outlined in the Bill of Rights.
 
The code affirms that every human being has the right to pursue both their material well-being and spiritual development in conditions of freedom, dignity, economic security, and equal opportunity. Additionally, it acknowledges every worker’s entitlement to a workplace free from violence and harassment, including gender-based violence and harassment. Harassment behaviors encompass various forms
such as physical, psychological, emotional, or sexual, and extend to workplace bullying.
 
All organizations are mandated to conduct a POLICY REVIEW of their harassment policy, including complaints and monitoring procedures. Key steps in this process involve integrating Gender-Based Violence policies and procedures, engaging in dialogue with the Executive team and the Employment Equity consultative committee regarding the implications and understanding of the Code, and ensuring proper policy adoption and communication.
 
Moreover, it is crucial to conduct policy communication and awareness training to ensure a comprehensive understanding of the policy in accordance with the Code and the company’s complaints procedure.
 
In case of any signs of Harassment in the workplace:
 
  • The employee must promptly report the misconduct.
  • Observers should take a stand and report any witnessed harassment.
